Your Parental Relocation Lawyer For Child Custody Moves

Last updated on April 15, 2026

Moving with your children after a divorce or custody order in Mississippi can be legally complex and emotionally draining. Everything revolves around the child’s interests, and you must involve your co-parent in decision-making. Whether you are considering a move with your child or you are trying to prevent your child from being relocated, working with a parental relocation lawyer is essential.

My name is attorney Rita Nahlik Silin, a solo practitioner at Silin Law Firm PLLC. Since 2007, I have been helping parents across Ocean Springs, Jackson County and the surrounding areas protect their parental rights and the interests of their children. With a focus on custody and family-related disputes, I have built my practice on a commitment to personalized and practical solutions.

When Is Court Permission Required For Parental Relocation In Mississippi?

Under Mississippi custody laws, court permission is required for parental relocation if there is an existing court order and the move significantly impairs the nonrelocating parent’s visitation. If you are moving within Mississippi for a short distance, you likely do not need a court’s permission.

However, if you are moving a significant distance within or outside the state, which may make a joint custody arrangement unworkable, you may need a court’s permission. Moving away with a child without the consent of the other parent can result in contempt of court or even a change of custody.

What If Your Child’s Other Parent Wants To Relocate?

Under Mississippi law, all custody orders require parents to keep each other informed of their addresses. As such, the moving parent should provide you and the court with their new address within five days after moving.

If the relocation affects your visitation rights, you can file a petition by showing a material change in circumstances to modify the existing order. Mississippi courts expect prompt action when you oppose relocation. That is why I am ready to help you file the petition on time and protect your bond with your child.
